By using the Whir service, browsing the website, or processing bitcoin anonymously through it, you confirm that you accept and consent to the present Terms. Whir keeps the right to revise these Terms whenever necessary by publishing the updated version on the website, with such revisions becoming effective from the moment they appear online.

1. Bitcoin and Whir

1.1 Information on the Bitcoin network

Our Service neither sends nor receives funds on its own — what we do is arrange interactions on the Bitcoin network in accordance with the parameters you provide.

As soon as the Bitcoin network registers the data from the transaction you've broadcast, that data gets relayed to other participants and entities operating on the network.

This Service cannot be used to cancel Bitcoin transactions or to recover funds already sent.

1.2 Bitcoin risks

Whir does not govern the Bitcoin network nor make any claims regarding its security. You acknowledge that interacting with the Bitcoin network carries inherent risks. We cannot accept liability for any missed earnings.

A Bitcoin transaction may stay unconfirmed for some time (typically under an hour, although in rare cases it can take several days). Should a transaction remain "unconfirmed," it may never finalize.

1.3 Working arrangements of the Whir service with end customers

The Service facilitates a private transfer from a freshly generated deposit address to your designated destination address. The Service shall not be held accountable for any action falling outside the scope outlined on its website or in these Terms. Examples include unauthorized Bitcoin sends to the service address, repeated transfers, or delays in transaction confirmation.

1.4 Your passwords and security

disrupting or meddling with the servers or networks that power the Whir services;
shutting down, overwhelming, or degrading Whir's performance (or that of any related network linked to the Service);
operating the Whir service or website for any purpose other than those clearly outlined in these Terms and the Privacy Policy;
any unlawful or deceitful conduct, including using this Service to launder illegal proceeds, finance terrorism, or take part in phishing, forgery, or any analogous fraud or manipulation schemes;
spamming, pyramid setups, or any other action repeating unsolicited messages, regardless of whether they are commercial or otherwise in nature.

2.4 Service updates

Whir may, at any moment, conduct unplanned work aimed at modifying, updating, or improving the service. We retain the right to introduce or eliminate features, and to discontinue operation of the Service and website entirely.

2.5 License and restrictions

Whir grants you a personal, nontransferable, and nonexclusive license that allows you to use the Service in the manner that Whir specifies for you. The license is offered subject to the conditions, limitations, and stipulations described throughout these Terms.

Beyond that, this license is intended strictly for personal, noncommercial purposes. You are prohibited from copying, modifying, building derivative works of, decompiling, or attempting in any way to extract the source code of the Service or any portion thereof, unless permitted by applicable law or explicitly authorized by the Whir platform.

Notwithstanding anything to the contrary, these Terms confer no license or right to reproduce, distribute, modify, or otherwise use any applications programming interface.

No proprietary or ownership rights tied to the Service are conveyed to you under these Terms. Whir retains every right that has not been specifically granted.

3. Users

3.1 Responsibilities

You bear sole responsibility for:

the nature, quality, and accuracy of the user data submitted to the Service;
promptly reviewing and responding to any notifications and obligations tied to your user data and activities, including messages dispatched by our help center.

You agree not to store or relay any prohibited information, including:

unlawful, defamatory, threatening, pornographic, offensive, or otherwise unacceptable content of any sort or kind;
any content that promotes illegal acts which may amount to a criminal offense, or that infringes upon intellectual property, publicity, or personal privacy rights of others;
any content that contains or makes use of software viruses or other harmful (or even seemingly harmless) computer code, files, or programs — such as trojan horses, worms, bots, or spyware — capable of damaging, jeopardizing, or oppressing another individual, entity, or Whir.

Whir prohibits use of the service in any manner that violates the law of the region in which you reside. This applies not only to using the service's features themselves but also to any related use cases involving the Bitcoin network.

Given that Whir collects no personal data — including any information about your geographic location — abiding by applicable national laws is entirely up to you. Whir assumes absolutely no liability in this regard.

4.2 Disclaimer of warranties

USE OF THIS SERVICE IS UNDERTAKEN ENTIRELY AT YOUR OWN RISK. WHIR DELIVERS THE WEBSITE AND SERVICE ON AN "AS IS," "WITH ALL FAULTS," AND "AS IS NOW" BASIS. WHIR EXPRESSLY DECLINES TO PROVIDE (AND DELIBERATELY DISCLAIMS) ANY AND ALL STATEMENTS OR WARRANTIES OF ANY TYPE — WHETHER IMPLIED, STATUTORY, OR OTHERWISE — INCLUDING, AMONG OTHERS, ANY WARRANTIES OF UNINTERRUPTED OPERATION OF THE SERVICE AND OF THE ABSENCE OF ERRORS OR HARMFUL COMPONENTS INTRODUCED BY THIRD PARTIES WITHOUT OUR KNOWLEDGE OR APPROVAL. WHIR IS UNABLE TO PROVIDE ANY GUARANTEES REGARDING SATISFACTORY QUALITY OF THE SERVICE, ITS SUITABILITY FOR ANY SPECIFIC PURPOSE, OR NON-VIOLATION OF ANY RIGHTS.

CERTAIN JURISDICTIONS DO NOT PERMIT THE ABOVE EXCLUSIONS. WHERE THIS APPLIES, SUCH EXCLUSIONS ARE INEFFECTIVE ONLY TO THE EXTENT BARRED BY THE APPLICABLE LAW.

TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, IN NO EVENT SHALL WHIR — NOR ITS EMPLOYEES, AGENTS, PARTNERS, VENDORS, OR LICENSORS — BEAR LIABILITY FOR ANY CONSEQUENTIAL, INCIDENTAL, INTENTIONAL, OR OTHER DAMAGES (INCLUDING, BUT NOT LIMITED TO, HARM ARISING FROM LOST PROFITS, REVENUE, OR REPUTATION) ARISING FROM USE OF THIS SERVICE.
